THC oil and wax is a concentrated form of cannabis that is created by extracting the active compounds from the plant. The product result is a highly potent oil or wax that contains high levels of tetrahydrocannabinol (THC), the psychoactive compound that is responsible for the "high" associated with cannabis use. THC oil and wax can be used for a variety of purposes, including medical treatments and recreational use.


Georgia Law on THC Oil

Georgia Law explicitly prohibits the possession of THC oil or wax. Possession of THC oil or wax is not just a simple misdemeanor offense in Georgia. In 2015, Georgia passed a law allowing the use of medical cannabis oil for specific medical conditions, but the law specifically states that the oil must contain "less than 5% THC, tetrahydrocannabinolic acid, or a combination of THC and tetrahydrocannabinolic acid which does not contain plant material exhibiting the eternal morphological features of the plant." Any oil or wax that contains more than 5% THC is illegal in Georgia and considered a Scheduled I controlled substance, a Felony.


Consequences/Punishment for Possessing THC Oil

Possessing THC oil, resin, or wax in Georgia can result in serious legal consequences. Those who are found in possession (including cartridges and/or vape pens) can face Felony charges, which can result in up to 10 years in prison and fines of up to $5,000.
